Terms & Conditions

These Terms and Conditions apply to all services provided by Monks Media through monks-media.com. By requesting a quote, engaging our services, paying an invoice, or using our website, you agree to these terms.

1. Our Services

Monks Media provides digital and creative services, including website design, branding, content creation, SEO, analytics, AI assistant setup, newsletters, social media support, and related marketing services.

The exact scope of work for each project will be set out in a proposal, quotation, email agreement, or invoice.

2. Quotes and Project Acceptance

All quotations are valid for 30 days unless otherwise stated.

A project is considered accepted when you do any of the following:

• approve a quotation or proposal

• pay a deposit or invoice

• instruct us to begin work

• continue with the project after receiving written terms

Once accepted, these Terms & Conditions apply to the project.

3. Payment Terms

All invoices are payable immediately upon receipt.

Payment must be made by:

• electronic bank transfer, or

• subscription setup, where applicable

Work may not begin, continue, or be delivered until payment has been received and cleared.

4. Monthly Retainers

All monthly retainer services are charged monthly in advance.

This means:

• payment must be received before the monthly service period begins

• retainers are ongoing unless cancelled in line with the notice period below

• unused time or services do not roll over unless agreed in writing

If payment is not received on time, Monks Media reserves the right to pause work until the account is brought up to date.

5. Website Design Payment Terms

For website design projects that are not part of a payment plan:

• 50% deposit is required before work begins

• the remaining 50% is due when the website is ready to go live

A website is considered ready to go live when the agreed work has been completed and presented for final approval or launch.

Monks Media reserves the right to withhold launch, transfer, or final handover until full payment has been received.

6. 12-Month Payment Plans

Where a project is agreed under a 12-month payment plan:

• the plan begins from the date of the first payment

• cancellation is allowed only within the first 3 months, subject to one month’s written notice

• after the first 3 months, the payment plan cannot be cancelled early

• all agreed payments remain due for the duration of the plan

7. Cancellation Policy

For monthly retainers and ongoing services, we require one month’s written notice prior to cancellation.

Notice must be given by email.

Services and charges will continue during the notice period.

For fixed-price projects, any work completed up to the cancellation date will remain chargeable. Deposits are non-refundable once work has started.

8. Revisions and Edits

Website quotations include reasonable edits only, which means up to 2 to 3 major rounds of revisions.

Examples of reasonable edits include:

• layout adjustments

• styling refinements

• content placement changes

• standard page-level revisions within the agreed brief

Additional edits beyond this, or any major changes outside the original scope, will be charged separately in addition to the original quotation.

9. Additional Work

Any work requested outside the original agreed scope may be treated as additional work.

This includes, for example:

• extra pages

• new features or functionality

• major redesign requests

• repeated revisions after approval

• additional integrations

• extensive copy or structural changes

Any additional work will be quoted and charged separately.

10. Content Ownership

All content, designs, code, graphics, layouts, concepts, and creative work produced by Monks Media remain the property of Monks Media until payment has been made in full.

This means:

• no rights transfer until all outstanding invoices are paid

• Monks Media retains ownership of all draft and unpaid work

• final approved deliverables may only be used once full payment has been received

Unless otherwise agreed in writing, Monks Media also retains ownership of working files, source files, and unused design concepts.

11. Client Responsibilities

To keep projects moving, clients must provide:

• content, images, and materials on time

• feedback and approvals within a reasonable timeframe

• accurate information

• access to relevant platforms or accounts where needed

Delays in receiving content, access, or approvals may affect project timelines.

12. Timelines

Any timeline given is an estimate unless specifically agreed as fixed in writing.

We are not responsible for delays caused by:

• late client feedback

• missing content

• delayed approvals

• third-party outages or technical issues

• circumstances outside our control

13. Third-Party Platforms and Tools

Some projects rely on third-party services such as hosting providers, domain registrars, plugins, email systems, analytics tools, payment platforms, or AI software.

Monks Media is not responsible for downtime, price changes, policy changes, outages, or service issues caused by third-party providers.

Any third-party subscription or licence fees are the client’s responsibility unless stated otherwise in writing.

14. Suspension of Work

Monks Media reserves the right to suspend work or withhold delivery where:

• invoices remain unpaid

• required information has not been provided

• approvals are unreasonably delayed

• there is misuse, abuse, or unlawful conduct

Suspension of work does not remove your obligation to pay any outstanding fees.

15. Limitation of Liability

We aim to provide all services professionally and to a high standard. However, Monks Media will not be liable for:

• loss of profits

• loss of business

• loss of data

• indirect or consequential loss

• issues caused by third-party software, platforms, hosting, or integrations

Our total liability for any claim relating to our services will be limited to the amount paid by you for the specific service in question.

16. No Guaranteed Results

While we work toward clear commercial outcomes, Monks Media does not guarantee specific results such as:

• search engine rankings

• lead volumes

• sales performance

• conversion increases

• uninterrupted website uptime

Any targets or projections discussed are estimates, not guarantees.

17. Portfolio Use

Unless agreed otherwise in writing, Monks Media may showcase completed work in our portfolio, marketing materials, proposals, or website.

This may include screenshots, project summaries, branding, and public-facing work.

18. Website Use

You agree not to misuse monks-media.com or attempt to:

• gain unauthorised access to systems

• copy or reproduce website content without permission

• introduce malicious code

• use the website for unlawful purposes

We reserve the right to restrict access where misuse is suspected.

19. Privacy and Cookies

Use of this website may also be governed by our Privacy Policy and Cookie Policy. These should be read alongside these Terms & Conditions.

20. Governing Law

These Terms & Conditions shall be governed by the laws of [insert jurisdiction].
